Effective date: October 19, 2026
These Terms and Conditions govern your use of the Upstream Livin website and purchases from Upstream Livin (“we,” “us,” or “our”). Please read them before purchasing. By affirmatively accepting these Terms at checkout, you agree to them. Our Privacy Policy explains our information practices.
1. Athletes and Family Use
The Playbook is intended for athletes and their families. Parents and caregivers should help younger athletes determine which information and activities are appropriate for their age, development, and individual needs.
2. The Playbook
The Upstream Livin Game Day Playbook is a digital educational resource for athletes and families. Your purchase includes the digital book and any bonuses expressly listed on the sales page at the time of purchase. It does not include individual coaching, medical care, a community membership, or a recurring subscription.
Descriptions, sample pages, and testimonials help explain the product. We do not guarantee any specific health, athletic, academic, emotional, or other result.
3. Pricing, payment, and delivery
Prices are shown in U.S. dollars unless stated otherwise. The price and any applicable taxes will be disclosed at checkout before you place your order. This is a one-time purchase, not an automatically renewing membership. Any expressly selected payment arrangement will be disclosed separately before purchase.
Sales tax
Upstream Livin initially collects applicable sales tax on taxable purchases in Texas. We monitor sales into other states to determine when additional registration and tax-collection obligations arise, including when applicable economic nexus thresholds are met. If we become required to collect tax in another state, we will register and begin collecting and remitting applicable state and local taxes within the timeframe required by that state’s law. Other legal grounds for tax collection may apply regardless of sales thresholds.
Whether tax applies and the amount charged depend on the purchaser’s location, the tax treatment of the product, applicable exemptions, and current law. Any tax charged will be shown at checkout before payment. Our collection practices may change as sales activity and tax laws change. The absence of a tax charge does not necessarily mean a purchase is exempt; purchasers may have a use-tax obligation under their state’s law.
After successful payment, we provide digital access using the access instructions supplied with your order. Please provide an accurate email address and check your spam folder if delivery does not arrive. Contact [email protected] for missing access, incorrect email details, or a damaged or unreadable file. You are responsible for having a compatible device, internet access, and software capable of opening the file format disclosed on the sales page.
4. No refunds
All sales of the Upstream Livin Game Day Playbook are final. Because this is a digital product, we do not offer refunds for change of mind or dissatisfaction after purchase, except where a refund or other remedy is required by applicable law.
If you experience a delivery or file problem, contact [email protected] so we can help resolve it. We will correct verified duplicate charges and provide any remedies required by law.
5. Updates and access
You may keep the copy of the Playbook you download, subject to these Terms. If you need help accessing your purchase, contact [email protected].
Your purchase includes future updated versions of the Upstream Livin Game Day Playbook as they are released. Keep your purchase email and contact information current so we can provide update access instructions. No specific release schedule is promised. Separate products or services are included only if expressly stated in the offer you purchased.
6. Copyright and permitted use
The Upstream Livin Game Day Playbook and accompanying original materials, including purchased bonuses, worksheets, checklists, text, graphics, and other protected content, are owned by Upstream Livin or the respective rights holders. Purchasing a product grants a license to use it; it does not transfer copyright ownership.
After successful purchase, we grant you a limited, nonexclusive, nontransferable license to download, read, and print the purchased materials for personal use within your household. You may use the materials with your children and print the included worksheets and checklists for your household. Materials supplied under a separate written license are governed by that license.
Except as permitted by law or our prior written permission, you may not copy, forward, email, upload, post, distribute, sell, sublicense, or otherwise provide the purchased files, protected content, download links, or login credentials to people outside your household. This includes unpaid access for friends, colleagues, business partners, teammates, other families, teams, schools, clubs, and organizations. Each additional household or outside user must purchase an appropriate license or obtain written authorization from us. Buying one copy does not authorize group distribution or use in a commercial program.
You may not remove copyright notices, claim the protected content as your own, or reproduce or adapt protected content into another product or resource without permission, except as permitted by law. These restrictions do not prevent uses permitted by copyright law, including applicable fair use, or restrict unprotected ideas, facts, or general knowledge.
Unauthorized copying or distribution may constitute copyright infringement and a breach of these Terms. Where legally available, Upstream Livin may pursue removal of unauthorized copies, orders stopping infringement, actual damages including provable lost sales or licensing revenue, infringer profits attributable to infringement, or statutory damages where eligible. We may also seek reasonable attorneys’ fees and court costs where permitted by law and awarded by a court. These remedies are subject to applicable legal requirements and limits; this provision does not impose an automatic fine or guarantee recovery of any amount.
For permission or team, school, or organizational licensing, contact [email protected].

Our role and the basis of the materials
Kelly Brooks Beck and Upstream Livin provide education informed by personal and family experience, athletic participation, coaching, and learning over time. Kelly and Upstream Livin are not medical providers and do not offer licensed medical diagnosis or treatment through these materials. Athletic and coaching experience is not a medical credential. Personal experiences and observations are not clinical trials or proof that a practice is safe or effective for every person. References to research or professionals do not mean that every recommendation has been clinically validated or that a professional has reviewed or endorsed the entire Playbook.
No professional relationship or individualized care
Purchasing or using our materials, receiving our emails, or communicating with us does not create a doctor-patient, therapist-client, dietitian-client, or other licensed healthcare relationship. General responses to questions are educational and do not constitute an individualized assessment, diagnosis, treatment plan, or medical clearance. We do not monitor your or your child’s health or provide emergency services.
Medical decisions and activity safety
Do not stop, start, or change prescribed medication or treatment based on these materials without consulting the appropriate treating professional. Do not disregard medical advice, delay care, or use these materials as a substitute for evaluation of symptoms. Seek emergency assistance for a suspected medical emergency.
Exercise, breathwork, temperature exposure, dietary changes, and supplements may involve risks or be unsuitable for some people, particularly children or people with medical conditions. Parents and caregivers should obtain qualified guidance about suitability, provide appropriate supervision, and stop an activity if concerning symptoms occur. General descriptions in the Playbook are not medical clearance to participate.
These provisions and the disclaimer above apply only to the extent permitted by law and do not excuse conduct or eliminate rights or remedies that cannot lawfully be excluded.
8. Testimonials, recommendations, and outside links
Testimonials describe individual experiences; results vary. Links and product references are provided for convenience and do not guarantee a third party’s quality, safety, or suitability. Third-party services have their own terms and privacy practices.
Where we receive a commission or other material benefit from a recommendation, we disclose that relationship with the relevant recommendation or link.
9. Acceptable use
You may not use the website unlawfully, interfere with its security or operation, attempt unauthorized access, commit payment fraud, or violate another person’s rights. We may restrict access for a material violation of these Terms, subject to applicable law. We will not use this provision to take away remedies you are legally entitled to receive.
10. Availability and warranties
We aim to provide accurate materials and reliable delivery, but website access may be interrupted and educational materials may contain errors or become outdated. To the extent permitted by law, the website and materials are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This does not exclude express commitments made at purchase or warranties that cannot lawfully be excluded.
11. Limitation of liability
For this section and section 12, the protected parties are Upstream Livin, the legal entity operating Upstream Livin, Kelly Brooks Beck, and their respective officers, members, employees, and contributors, acting within their roles in providing these materials.
To the extent permitted by law, these protected parties are not liable for indirect, incidental, special, or consequential losses arising from your use of the website or materials. To the extent permitted by law, the combined total liability of the protected parties for a claim arising from your purchase or use of the Playbook is limited to the amount you paid for that product.
These limitations do not apply to fraud, willful misconduct, gross negligence, or any liability or remedy that applicable law does not allow us to exclude or limit. Your mandatory consumer rights remain in effect.
12. Limited indemnification for wrongful conduct
To the extent permitted by law, you agree to indemnify Upstream Livin and the other protected parties identified in section 11 for reasonable losses, damages, and legal costs arising from a third party’s claim, but only to the extent caused by your unlawful conduct, knowing unauthorized distribution of the materials, or infringement of that third party’s rights in content you submit to us.
This obligation does not apply to losses caused by a protected party’s negligence, gross negligence, willful misconduct, fraud, violation of law, or breach of these Terms. It does not require you to indemnify us merely because you or your child used the Playbook or experienced an unfavorable outcome, and it does not require reimbursement for bringing a good-faith complaint or claim against us.
We must give you prompt notice of a claim for which indemnification is sought and a reasonable opportunity to participate in its resolution. No settlement requiring you to admit fault or assume obligations may be imposed without your written consent. Recovery under this provision is subject to applicable law and cannot duplicate amounts otherwise recovered.
13. Applicable law and resolving concerns
Texas law governs these Terms, without regard to conflict-of-law rules, except that mandatory protections under other applicable laws remain in effect. Please contact [email protected] with purchase concerns so we can try to resolve them. Contacting us first is encouraged but is not a condition of exercising your legal rights. These Terms do not require arbitration or waive access to small claims court.
14. Changes and remaining provisions
We may revise these Terms for future website use or purchases by posting a new effective date. The Terms accepted when you purchased govern that purchase unless a lawful change is separately agreed to. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
